Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Proxy Software Group LLC, a Texas limited liability company ("TuneChief," "we," "us," or "our"), governing your use of the TuneChief™ website at tunechief.com and app (together, the "Service"). By using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

1. The Service

TuneChief is a software tool for drag racers that provides air/density-altitude readings, ET and MPH predictions, dial-in help, datalog analysis, a practice tree, a logbook, and an AI "Crew Chief." All outputs are informational estimates to assist you — not professional advice or guarantees of performance, safety, or results.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live) to buy a subscription or pass, and at least 13 to use the free Service. You're responsible for keeping your access secure.

3. Plans, billing & renewals

• Free — $0, no card required, with limited features (including a monthly cap on Crew Chief conversations).
• Founder 100 — $99/year, an introductory price locked for as long as your subscription stays active. Billed annually and renews automatically each year until you cancel.
• Weekend Pass — $14.99, a one-time purchase unlocking full features for a single race weekend (no subscription). If you upgrade to an annual plan within 30 days, the $14.99 is credited toward it.
• After the Founder 100 spots sell out, the standard plan (TuneChief Pro) is $149/year. Existing founders keep $99.

Prices are in U.S. dollars and may change for future purchases; we'll honor the price locked at the time you subscribed for as long as your subscription remains active. Payments are processed by Stripe; by purchasing, you also agree to Stripe's terms.

4. Cancellations, refunds & our guarantee

You can cancel an annual subscription anytime; cancellation stops the next renewal, and you keep access through the end of your paid term. Except where required by law or as expressly stated here, payments are non-refundable.

Win-a-round guarantee: where we advertise a money-back guarantee, it applies as described in that specific offer. To request a refund under an active guarantee, contact admin@tunechief.com within the stated window.

5. Acceptable use

You agree not to misuse the Service, including: reselling or redistributing it, reverse-engineering it, scraping it, overloading it, uploading unlawful content, or using it to violate anyone's rights. We may suspend or terminate access for violations.

6. Safety & assumption of risk

Motorsports are inherently dangerous. TuneChief does not inspect your vehicle, control your driving, or make any decision for you. You alone are responsible for your vehicle's condition, your tuning and setup choices, your safety equipment, compliance with track and sanctioning-body rules, and your driving. Always follow your track's safety requirements.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS (INCLUDING AI SUGGESTIONS, PREDICTIONS, AND DATALOG ANALYSIS) WILL BE ACCURATE, COMPLETE, OR RELIABLE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROXY SOFTWARE GROUP LLC AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY VEHICLE DAMAGE, PROPERTY DAMAGE, INJURY, LOST DATA, LOST PROFITS, OR RACE OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Proxy Software Group LLC from claims, losses, and expenses arising out of your use of the Service or your violation of these Terms.

10. Intellectual property

TuneChief™, its logo, content, and software are owned by Proxy Software Group LLC and protected by law. We grant you a limited, non-transferable license to use the Service for its intended purpose. You keep ownership of the data and content you enter. TuneChief is not affiliated with, endorsed by, or sponsored by Holley Performance, FuelTech, or Haltech; those names are trademarks of their respective owners.

11. Changes to the Service or Terms

We may modify the Service or these Terms at any time. If we make material changes, we'll update the effective date and post the new Terms here. Continued use after changes means you accept them.

12. Termination

You may stop using the Service anytime. We may suspend or end your access if you violate these Terms or to protect the Service. Sections that by their nature should survive (payment, disclaimers, liability limits, indemnification) survive termination.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Texas for any dispute not subject to other agreed resolution.
